General Terms and Conditions

The General Terms and Conditions govern the contractual relationship between Dr. Giuseppe Scuto (hereinafter referred to as the Counselor) and the Client for the use, payment and execution of the contractually agreed services. They apply to all business transactions with the Client and are an integral part of the coaching or counseling contract. Deviating terms and conditions shall not apply unless they have been set out in writing and and are an integral part of the contract.

Preamble

The Counselor provides coaching and consulting services in accordance with the present Terms and Conditions that, upon commissioning, are accepted by the Client.

Conclusion of contract

Any counseling contract must be in written form and be signed by both Counselor and Client. Upon request, the Counselor will prepare a cost estimate for the Client.

Right of withdrawal

The Client has a four-week right of withdrawal after signing the contract with the Counselor. This right expires if the Counselor, in agreement with the Client, provides any services before the four-week deadline.

Place and time of the provision of services

As a rule, counseling takes place via the Internet or by telephone. Exceptions can be made individually at the request of the Client after consultation and mutual written agreement. The dates of the counseling sessions are agreed between the Counselor and the Client according to their mutual availability. The Client undertakes to attend the sessions punctually.

Fee and terms of payment

The Client shall pay the agreed amount to the Counselor in cash on the agreed date or by bank transfer upon receipt of the invoice. The agreed fees for the commissioned and provided services are due immediately upon receipt of the invoice and without any deduction.

If the Client is unable to keep an appointment, he/she must inform the Counselor at least 2 working days in advance. In the event of later notification, 50% of the fee will be charged. In the event of a no-show without notification, the full fee is due.

Force majeure and other impediments to performance

The Counselor is entitled to postpone the agreed coaching appointments in the event of force majeure, including hindrances due to illness, accident or similar. In this case, the Counselor shall inform the Client as soon as possible and offer an alternative date. If the Client could not be reached at the telephone number provided and in any other case, there is no entitlement to reimbursement of any incurred costs.

Copyright

Unless otherwise agreed, all documents handed over to the Client are included in the agreed remuneration. The documents are intended for the personal use of the Client. They are subject to the confidentiality agreement.

All documents, information and data relating to the Client provided to the Counselor during the provision of the session shall be treated confidentially and shall not be made accessible to third parties without previous written agreement with the Client.

Insurance cover

Clients bear full responsibility for themselves and their actions inside and outside the counseling sessions and are liable for any damage caused. Counseling is not psychotherapy and does not replace it.

Liability and warranty

The Counselor will provide all commissioned services to the best of his knowledge and belief. If one of the parties is unable to attend an appointment, an alternative appointment will be arranged.
 The Counselor's activity is purely a service activity. Success is not owed. Liability is excluded. The dispatch or electronic transmission of any data is at the risk of the Client.
